By accessing or downloading content from a gallery provided by Blackwater Social Marketing (“we”, “our”, “us”), you agree to the following terms.

1. Content Ownership & Usage

All photos, videos, and digital media contained within the gallery remain the intellectual property of Blackwater Social Marketing unless otherwise agreed in writing.

Upon full payment of the relevant project invoice, the client is granted an ongoing licence to download, use, publish, and distribute the delivered content for their own business and marketing purposes.

This includes use across websites, social media, digital advertising, print marketing, and internal business use.

The client may not resell, redistribute, or claim authorship of the content.

2. Use By Other Agencies & Third Parties

Other marketing agencies, creative agencies, media companies, contractors, or third-party service providers may use the supplied content only for the purpose of providing services directly to the client.

Third parties must not use the content in their own advertising, social media, website, portfolio, case studies, promotional material, or sales material without prior written approval from Blackwater Social Marketing.

This includes, but is not limited to, using the images or videos to promote their own photography, videography, marketing, design, website, advertising, or content creation services.

3. Downloads & Access

Clients are responsible for downloading and storing their delivered content after receiving access to the gallery.

While we aim to keep galleries available for a reasonable period of time, we do not guarantee permanent storage or ongoing hosting of files.

We recommend all clients maintain their own backups of downloaded content.

4. Editing & Alterations

Clients are permitted to resize, crop, or lightly edit content for marketing purposes.

However, major alterations, filters, or edits that significantly change the original work should not be attributed to Blackwater Social Marketing.

5. Gallery Sharing

Clients may share gallery links internally within their business or with approved team members.

Public sharing of private gallery links should be done at the client’s discretion.

6. Limitation of Liability

Blackwater Social Marketing is not responsible for loss of downloaded files after delivery, third-party misuse of shared gallery links, platform outages or temporary gallery unavailability, client-side storage failures, or data loss.

Our total liability relating to any content delivery shall not exceed the amount paid for the associated project.

7. Acceptance

By accessing or downloading files from the gallery, you acknowledge and accept these Terms of Service.
